Complainant begs court to terminate assault charge

Abuja, June 23, 2017 (NAN) A complainant in an assault case, Mr Paul Izuagbe, on Friday begged a Gudu Upper Area Court, Abuja, to terminate an assault matter pending before the court.
Izuagbe of Karamadidi, Airport Road, pleaded with the court not to continue with the matter as the parties involved had shown remorse and regretted their actions.
The judge, Mr Umar Kagarko, after citing relevant sections of the Administration of Criminal Justice Act (ACJA), discharged the defendants and terminated the matter.
Kagarko said he did this in the interest of justice, adding that “settlement is better than litigation.’’
According to the prosecuting counsel, Mr Fidelis Ogbobe, the complainant reported the matter at Wuye Police Station on June 13.
He said the defendants involved were: one Mrs Sophy Stephen and her husband, Mr Stephen Bernard of the same address.
Speaking in an interview with the News Agency of Nigeria (NAN), Ogbobe said that the case was a three-count charge of criminal conspiracy, criminal intimidation, assault and causing hurt
He said that the complainant had alleged that the first defendant, Stephen was involved in a motorcycle accident in front of his house.
“She then went and told her husband, Stephen Bernard, the second defendant, that it was the complainant’s dog that caused the accident to happen,’’ Ogbobe said.
He also said that the second defendant then went and conspired with six others, now at large, to beat up the complainant.
Ogbobe said that they used a pestle to hit the complainant on the right hand.
The offence is contrary to Sections 96, 397 and 265 of the Penal Code. (NAN)
