    Abuja, June 11, 2024 (NAN) The Federal High Court (FHC) will, on July 23, begin  its annual vacation.

    The FHC Assistant Director of Information/ICT, Dr Catherine Oby-Christopher, made this known in a statement on Tuesday in Abuja.

    The statement was titled: “Notification of Federal High Court Annual Vacation for the Year 2024 and Vacation Roster For Judges.”

    It reads in part: “By virtue of the provisions of Order 46, Rule 4 (d) of the Federal High Court (Civil Procedure) Rules 2019, the Chief Judge of the Federal High Court of Nigeria, Honourable Justice John Terhemba Tsoho, OFR, KSS, FCIArb.(UK) announces its 2024 Annual Vacation and Roster for Vacation Judges.

    “The vacation will commence from Tuesday, the 23rd day of July 2024 to Sept. 13.

    Normal court sitting, it added will resume on Sept. 16,  2024.

    “This is in order for judges to enjoy their well- deserved rest and to prepare for the tasks and activities of the New Legal year.”

    The statement advised the litigating public to approach Abuja, Lagos and Port-Harcourt divisions of the court for matters of extreme urgency during the period.

    Justice Emeka Nwite and Justice Peter Lifu of the Abuja division; Justice Akintayo Aluko and Justice Isaac Dipeolu for Lagos division and Justice A. T. Mohammed and Justice P. M. Ayua for Port- Harcourt were appointed vacation judges .(NAN)(www.nannews.ng)

  • 4 docked for allegedly stealing pumping machines, cables, others

    Ibadan, June 11, 2024 (NAN) A 63-year-old man, Moses Sodeinde, and three others were on Tuesday arraigned before an Ona-Ara Magistrates’ Court, Ibadan, over alleged stealing of pumping machines, cables and others items.
    The defendants, whose addresses were not provided, were charged with conspiracy, burglary and stealing, to which they, however, pleaded not guilty.
    The Prosecutor, Insp Folarunmi Adeshina, told the court that the defendants committed the offences between July and October 2023 at Oilfem Plantation Ltd. and Oyo State Small Scale Industries premises at Iyaganku area of Ibadan.
    Adeshina said that the defendants broke into the offices at the aforementioned area and stole valuables worth N3,458,800.
    He listed the valuables to include: pumping machines, installation pipes, wedding set equipment, hydraulic cutting machines, compressors, cables and others.
    According to him, the offences contravene Sections 516, 413 and 399(9) of the Criminal Laws of Oyo State, 2000.
    The Magistrate, Mr Ayorinde Ayo-Alagbe, granted the defendants bail in the sum of N500,000 each, with two sureties each in like sum.
    Ayorinde, thereafter, adjourned the case till Sept. 10 for hearing. (NAN) (www.nannews.ng)

  • Man, 29, in court for allegedly dealing in cannabis, codeine

    Lagos, June 11, 2024 (NAN) National Drug Law Enforcement Agency (NDLEA) on Tuesday arraigned a 29-year-old man, Michael Ishola, before a Federal High Court in Lagos over alleged drug trafficking.

    The defendant is facing a two-count charge bordering on illegal dealing in 500g of cannabis and 0.9 litres of codeine.

    The NDLEA Prosecutor, Ms N.J. Erondu, said that the defendant committed the offences on May 7 at Mushin area of Lagos.

    Erondu said that Ishola was found in possession of 500g of cannabis and 0.9 litres of codeine, which was unlawful.

    She said the drugs, which were later recovered from him, had been classified as psychotropic substances, similar to cocaine and heroin.

    According to the prosecutor, the offences contravene the provisions of Section 11(c) of the NDLEA Act, Cap N30, Laws of the Federation, 2004.

    The News Agency of Nigeria (NAN) reports that no date has, however, been fixed for arraignment of the suspect. (NAN) (www.nanews.ng)

  • Mechanic jailed 8 months for stealing customer’s vehicle parts

    Kaduna, June 11, 2024 (NAN) A Kaduna Chief Magistrates’ Court on Tuesday sentenced a 38-year-old mechanic, Samson Dogo, to eight months imprisonment for stealing his customer’s vehicle parts.

    The Magistrate, Ibrahim Emmanuel, jailed Dogo, of Malali, Kaduna, without an option of fine.

    Emmanuel said that the sentence followed the convict’s guilty plea to the two-count charge of conspiracy and stealing.

    He said that the punishment would have been more severe if he had not pleaded guilty and saved the court the pains of prolonged prosecution.

    The magistrate warned the convict against taking to crimes again and ordered him to restitute the sum of N503,000 to the complainant, Michal Edward.

    Earlier, the Prosecutor, Insp Chidi Leo, said that the defendant committed the offences on June 4 at Malali, Kaduna.

    Leo said that the defendant collected the sum of N398,000 from the complainant and promised that he would buy a new engine for his Toyota Camry car and fix it, a representation he knew to be false.

    The prosecutor said that the defendant did not buy the engine or fix it but converted the money to his personal use and stole some parts of the car.

    “The defendant also stole two of the car tyres, valued at N83,000 and the front bumper, valued at N22,000.

    “All efforts made by the complainant to get his money back failed,’’ Leo said.

    The prosecutor said that the offences contravened the Penal Code of Kaduna State, 2017. (NAN) (www.nannews.ng)

    Kaduna, June 11, 2024(NAN) A 30-year-old security guard, Mustapha Ahmed, was on Tuesday docked in a Kaduna Chief Magistrates’ Court for allegedly stealing his employer’s gold jewelly worth N1.9 million.

    Ahmed, who resides in  Kawo area of Kaduna is charged with three counts of criminal conspiracy, breach of trust and theft..

    The Prosecution Counsel, Insp Chidi Leo, told the court that the defendant and two others at large, on June 4 committed the offence at the Ungwan Sarki, Kaduna.

    According to Leo, the defendant and his accomplices also N450, 000 cash from his employer .

    “Other items stolen are: a Iphone valued at N430,000 and one HP Laptop worth N200,000, laptop adaptor and one webcam worth N17, 500.

    The prosecutor further stated that the defendant was caught on CCTV committing the crime.

    He said that the offence contravened the provisions of Penal Code of Kaduna State, 2017.

    The defendant pleaded not guilty to the charge.

    The Magistrate, Ibrahim Emmanuel, admitted Ahmed to bail in the sum of N200,000 with two sureties in like sum.

    Emmanuel ordered that the sureties must be gainfully employed and should reside within the court’s jurisdiction.

    He further ordered the sureties to provide evidence of tax payment to Kaduna State Government.

    He adjourned the case until July 18, for hearing. (NAN)

  • Police arraign 4 for allegedly stealing motorcycle

    Badagry (Lagos State), June 11, 2024 (NAN) The Police in Lagos on Tuesday arraigned four men before a Badagry Chief Magistrates’ Court for allegedly stealing a Haojue lady’s motorcycle.

    The defendants, Sodiq Sunday, 29; Azeez Monsuru, 19; Dada Musa, 43 and Bankole Agosu, 45, whose addresses are unknown, are standing trial on a two-count charge of felony and stealing.

    The defendants, however, pleaded not guilty to the charges.

    The Prosecutor, ASP Edet Ekpe, told the court that the defendants committed the offences on June 1, at about 5.30.a.m., at Aradagun area of Lagos.

    Ekpe said that the defendants conspired among themselves to commit felony to wit: stealing.

    The prosecutor said that they stole one Haojue lady’s motorcycle, valued at N1.5 million, belonging to one Nasiru Usman, the complainant.

    The offences, he said, contravened Sections 411 and 287 of the Criminal Law of Lagos state, 2015.

    The Chief Magistrate, Mr N.A. Layeni, granted the defendant bail in the sum of N500,000 each, with two sureties each in like sum.

    He said that one of the sureties must be gainfully employed while the other must be a civil servant.

    Badagry (Lagos State), June 11, 2024 (NAN) A 41-year-old mechanic, Bebe Akapo was on Tuesday arraigned  in a Badagry Chief Magistrates’ Court over alleged stealing of three cars.

    The defendant, whose address is unknown, is standing trial on a two-count charge of felony and stealing.

    The defendant, however, pleaded not guilty to the charges.

    The prosecutor, Insp Edet Ekpe told the court that the defendant committed the offence on March 25, at No 8 Wale Ajose Street, Abule Era, Ilogbo, Lagos,

    Ekpe said that the defendant allegedly conspired among others who were at large to commit felony to wit stealing three cars.

    “The defendant stole two Toyota Sienna space cars and one Toyota Camry car with registration number LSR 928 HE, KSF 497 EP, and SMK 373 FL belonging to Mr Bashir Qudus, Yusuf Ganiyu and Yusuf Bashiru, the complainants.

    He said that the contravened Sections 411 and 287 of the Criminal Law of Lagos state, 2015.

    The Chief Magistrate, Mr N A Layeni granted the defendant bail in the sum of N1million with three sureties in like sum.

    He said that one of the sureties must be a community leader with three year tax clearance.

    Jos, June 11, 2024 (NAN) An Area Court in Jos on Tuesday, sentenced Isah Abubakar, Abdulrazak Salihu, to three months imprisonment each for fighting in public and constituting a nuisance.

    The judge, Shawomi Bokkos, sentenced the convicts after they pleaded guilty to the offence.

    The judge, however gave the convicts an option of N 10,000 fine each or three months imprisonment for disturbing the peace of the public.

    Earlier, the police prosecutor, Insp Monday Dabit, told the court that information was received at the Laranto police station that the convicts were engaged in a fight behind the St Auustine Major Seminary.

    Dabit said that during police investigation,  the suspects confessed to the crime.

    The police prosecutor, said the offence contravened the provisions of Section 83 of the Plateau State Penal Code Law of Northern Nigeria. (NAN)(www.nannews.ng)

    Jos, June 11, 2024 (NAN) An Area Court in Jos on Tuesday, sentenced Murtala Gamboo a security man and his friend, Abdullahi Ibrahim, to 18 months imprisonment each for stealing a tricycle worth N N2.7m

    The judge, Shawomi Bokkos, sentenced the convicts after they pleaded guilty to the offence.

    The judge, however gave the convicts an option of N 20,000 fine each or six months imprisonment for criminal conspiracy.

    He ordered them to pay a compensation of N2,7m or spend 12 months in default.

    Earlier, the police prosecutor, Insp Labaran Ahmed, told the court that the case was reported at the C Division police station Jos, on May 15, by Mr Mohammed Ahmed.

    He said the complainant said he parked his tricycle, in the custody of Gambo, who conspired with Ibrahim.

    stole his tricycle valued at N2,700,000, from where it was parked.

    The prosecutor, further told the court that during police investigation, the convicts confessed to have committed the offence .

  • LGs full autonomy will further improverish downtrodden – Kwara Govt.

    Abuja, June 11, 2024 (NAN) The Kwara State Government has asked the Supreme Court to dismiss the suit filed by the Federal Government seeking full autonomy for the 774 Local Government (LG) Councils in the country.

    In a legal process filed at the apex court, the state contended that granting the reliefs sought by the federal government, “will further impoverish most Nigerians who are downtrodden in the local government areas”

    The Counter Affidavit to the Originating Summons of the federal government filed by the Kwara Attorney-General and Commissioner for Justice, Senior Ibrahim-Sulyman, was obtained by the News Agency of Nigeria on Tuesday in Abuja.

    The state AG asked the apex court to dismiss the Originating Summons of the federal government and the reliefs sought therein, in the interest of justice.

    NAN recalled that the Federal Government instituted the legal action against the Attorney General of the 36 states, over alleged misconduct in the administration of local government Councils.

    The suit filed by the Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi (SAN), is seeking full autonomy for all local government councils in the country.

    In the suit, the Federal Government specifically prayed the court to issue an order, prohibiting state governors from embarking on unilateral, arbitrary and unlawful dissolution of democratically elected local government leaders.

    Fagbemi urged the court to grant an order for the withhold of the fund meant for the local governments in such states that unlawfully dissolve democratically elected local government officials and run them through illegal Transitional Implementation Committee.

    He prayed the Supreme Court for an order to allow the monthly allocations of LGs to be directly paid to them from the Federation Account in line with the provisions of the Constitution as against the alleged unlawful joint accounts created by governors.

    The Kwara AG, who is the 23rd defendant in the case, however, said the agitation of the plaintiff regarding joint account “is grossly misconceived and a contradiction to the provisions of Section 162 (6) and (8) of the Constitution.

    The section, according to the AG provides that funds meant for the local governments “must be allocated to the state in a special statutory account and shall in turn be distributed to all the LGs in the state in such terms as may be prescribed by the state’s House of Assembly”

    Ibrahim-Sulyman also argued that the misconception of the federal government should be nip in the bud because of an earlier decision of the apex court in a similar case, between Abia State and the Attorney General of the Federation.

    He referred to the subsisting judgment of the court delivered by a former Supreme Court Justice, Late Justice Nikki Tobi, in the case, which held:

    “The National Assembly cannot validly make a law permitting the direct allocation of funds to the local government Councils.

    “Rather, such money must be allocated directly to the state, which shall in turn pay same into the state joint local government account vide section 162 (6) of the Constitution”.

    Ibrahim-Sulyman argued that, going by the decision of the court, the federal government in the present case “is turning itself into performing the function of the legislature.

    “The ideal thing is for the plaintiff to ensure that a Bill is sponsored for the amendment of the constitution or a new statute to that effect.

    ‘The plaintiff cannot use the back door of the judiciary to import into our law what is not legislated upon by the National Assembly,” the AG said.

    He added that contrary to the position of the plaintiff, there was no time Kwara state failed to disburse funds from the federation account meant for the local government.

    “The allocation meant for the local governments in the state are released for the use of the local governments, monthly,” he said.

    The Kwara AG also argued that the state was not in the habit of truncating democracy at the local government level as alleged by the federal government.

    He said the earlier scheduled local government elections in the state could not hold due to protracted litigation on the tenure of the Kwara State Independent Electoral Commission.

    Ibrahim-Sulyman said the state had rolled out the schedule for the elections to hold into various local government Councils on Sept. 21, 2024.

    Besides, the Kwara AG, said, the federal government has no power, whatsoever, to refuse to release the funds meant for the local governments to the states.

    Sulyman said payment of the LGs monthly allocations from the federation account to the state is a mandatory statutory provision.

    He cited a case between Lagos State Attorney General vs AGF, filed when Tinubu was Lagos state governor and former President Olusegun Obasanjo, withheld the allocation meant for the state for creating additional 37 Local Council Development Areas.

    The apex court decision in the case, according to the AG is: “the President has no power vested in him to suspend or withhold for any period, whatsoever, the statutory allocations due to Lagos state pursuant to the provisions of Section 162(5) of the 1999 Constitution.

    The AG, therefore urged the apex court to hold that the federal government has no constitutional power to stop, redirect or withhold the statutory allocations meant for the local government councils in Kwara.(NAN)
