Unemployed in court for breaking shop-wall to commit felony

Lagos, Jan. 20, 2017(NAN) A 31-year-old unemployed , Rapheal Ifediegwu, who allegedly broke the wall of a shop in order to steal, was on Friday hauled up before an Ikeja Magistrates’ Court in Lagos.

Ifediegwu, a resident of Camp Davis Road, Ayobo area of Lagos State, is being tried for shop-breaking and intent to commit felony.

According to the prosecutor, Insp. Clement Okuoimose, the accused committed the offences on Jan. 8 at Stellim Plaza, Ayobo, Lagos

He said that the accused, unlawfully, broke the wall of a shop belonging to one Mr Ayo Amusan at night to commit felony.

“The accused broke the wall of the complainant’s shop in order to gain entrance to steal his motorcycle’s spare parts,” he said.

Okuoimose said that the accused without lawful excuse had in his possession an instrument meant for house breaking.

“The accused came with sophisticated weapons to damage the wall of the shop,” he said.

The prosecutor said that a neighbour who was living at the back of the complainant’s shop heard the sound of the action and decided to trace the place.

“The noise coming from hitting a building wall with the intention to break a part of it attracted the complainant’s neighbour who traced where it was coming from.

“He met the accused in possession of a heavy iron rod which he had used to create a hole in the building’s wall.

“He raised an alarm and other neighbours rushed out, apprehended the accused and handed him to the police,” he said.

The prosecutor said that the offences contravened Sections 307, 310 and 337 of the Criminal Law of Lagos State, 2011.

The News Agency of Nigeria (NAN) reports that the accused may be jailed seven years if found guilty according to the provisions of Section 307.

The accused pleaded innocence of the offences and was granted bail in the sum of N40,000 with two sureties in like sum.

The magistrate, Mrs O.Y. Ekogbule, adjourned the case to Feb. 27 for mention. (NAN)
