Patent medicine dealer charged with culpable homicide loses no-case submission

Abuja, March 5, 2018 (NAN) An FCT High Court, Maitama, on Monday dismissed the no-case submission filed by one Peter Cletus, charged with culpable homicide.
Justice Jude Okeke, in his ruling, held that the no-case submission lacked merit because the prosecution had established a prima facie case against the defendant.
Okeke held that the prosecution had established the essential ingredient to warrant the defendant to enter his defence.
The judge said that from the evident so far adduced, the act of the defendant led to the death of the deceased.
He added that the prosecution called two witnesses to testify after which the defendant applied for the no-case submission.
The judge ordered the defendant to enter his defence to prove his innocence in the allegation leveled against him and adjourned the case until March 15 for the Cletus to open his defence.
Cletus was arraigned in February 2013, on a count charge bordering on culpable homicide.
The prosecution alleged that, Cletus, in his illegal chemist shop at Kabusa village, Abuja, administered an injection, not prescribed by a physician on the deceased, Blessing Apenda, with an intention to terminate her four-month old pregnancy.(NAN)
