Abuja, March 15, 2018 (NAN) An FCT High Court, Maitama, on Thursday ordered a patent medicine dealer Peter Cletus, charged with culpable homicide to open his defence on April 10.
Justice Jude Okeke, adjourned the matter after the defence counsel, Mr Harold Mackay informed the court that the prosecution, Mr Babajide Olanipekun was not in court due to another matter he was involved in at Gwagwalada.
Mackay also told the court that he was not ready with his witnesses and therefore prayed for an adjournment.
Cletus was arraigned in February 2013, on a count charge bordering on culpable homicide.
The prosecution alleged that, Cletus, administered an injection, not prescribed by a physician on the deceased, Blessing Apenda, with an intention to terminate her four-month old pregnancy at his illegal chemist shop at Kabusa village, Abuja.
NAN reports that the accused in the course of the trial, filed a no-case-submission.
Ruling on the no-case submission then, Okeke held that it lacked merit because the prosecution had established a prima facie case against the defendant.
He added that the prosecution had established the essential ingredient to warrant the defendant to enter his defence.(NAN )
