Court to rule on NUC Staff Cooperative suit Feb.27

Abuja,Feb.2,2017(NAN) The National Industrial Court, Abuja, will on Feb, 27 rule on the preliminary objection brought by the National University Commission Staff Multipurpose Cooperative Society against one Victor Uyo, an official of the cooperative.
The judge, Justice Edith Agbakoba, fixed the date after listening to the submissions of counsel to both parties.
The NUC Cooperative is asking the court to strike out the suit instituted by Uyo, for lack of diligent prosecution
At the resumed hearing on Thursday, counsel to the respondents, Mr M.Okewuchi, told the court that he had a preliminary objection and was ready to move the application.
Moving the application, Okewuchi prayed the court to strike out the claimant’s suit for want of diligence.
He claimed that there was a discrepancy in what the claimant filed in the Federal High Court and the reliefs sought at the National Industrial Court.
Okewuchi argued that the case being a transferred suit should still have the same reliefs and facts.
The preliminary objection was, however, opposed by counsel to the claimant, Mr Isaac Ebikwo, who told the court that there was no alteration in the processes.
” We urged the court to dismiss the preliminary objection raised by the respondent as it is just to waste the time of the court,” he said.
The court will also rule on the motion filed by Uyo seeking the leave of court to change the title of the suit.
The motion was opposed by Okewuchi who urged the court to strike out the suit saying that the claimant has ” nothing before the court”.
Uyo, who is the treasurer of the NUC Multipurpose Cooperative Society, had sued the Cooperative challenging an alleged interdiction placed on him in 2007.
The claimant is asking the court to lift the interdiction allegedly placed on him in 2007 by the cooperative.
The claimant also prayed the court to order the respondent to pay him all his salaries and entitlements as well as withdraw the publication of the said interdiction in the cooperative’s bulletin.
Uyo joined the NUC as co- respondent.NAN)
