Abuja, Dec. 7, 2016 (NAN) An FCT High Court in Maitama on Wednesday adjourned ruling in a case of no submission in alleged murder case until Feb. 27.
Anayo Eze, 19, Idris Shaibu, 22, Okechuhukwu Nelson, 27, Emmanuel Igwe, 19, Samuel Okoro, 19 and Augustine Nwamba, 47, were alleged to have killed Anthony Eze, a business man.
The News Agency of Nigeria (NAN) reports that late Eze was murdered on Nov. 6, 2014 by unknown persons after he took some of his friends to a bar in Zuba, Abuja.
The Judge, Justice Salisu Garba, adjourned the matter after the counsel for defence filed and adopted a case of no submission.
Garba also ordered that the defendants should be remanded in the prison custody until the next adjourned date.
At the resumed hearing, the prosecuting counsel, Mr Malik Taiwo, told the court that he had closed his case for defence to open theirs after bringing six witnesses.
Mr Anthony Oguajamma, counsel for the 4th and 6th defendants told the court that
prima facie was not established against his clients.
He said that the prosecution built his case on the “ purported confessional“ statement made by the 1st defendant.
He, therefore, urged the court to discharge his clients and dismiss the case.
Mr Obinna Onu, counsel for the 1st defendant, told the court that there was no case established by the prosecution to warrant a defence in the case and that it was a case of no submission.
The counsel for 5th defendant, Mr Nsikak Udoh, told the court that his client was away for work at Lokoja on the day of the incident and had raised an alibi.
He said that the prosecution failed to investigate the alibi and hence a case of no submission.
The prosecuting counsel, Taiwo, told the court that he had already filed replies to all on the case of no submission by the defence counsel. (NAN)
