Stagnation

Abuja, Feb. 27,2017(NAN) The National Industrial Court, Abuja, has fixed April 3, to rule in a motion filed by the Nigeria Immigration Service (NIS) challenging the competence of an alleged stagnation suit filed against it by Daniel Makolo.
Makolo, an estranged senior officer of NIS instituted the suit on alleged denied promotion of his elevation since 1992.
The News Agency of Nigeria (NAN) reports that the claimant is seeking elevation to the rank of Deputy Comptroller-General of Immigration.
Other respondents listed in the suit are Chairman, Code of Conduct Bureau, Chairman, ICPC, and the Minister of Interior.
The Presiding Justice, Justice Edith Agbakoba, fixed the date after hearing the preliminary objections raised by counsel to the parties.
The respondent had jointly argued that the claimant’s prayer had been overtaken by events, adding that the suit should not be entertained.
The court would therefore determine the issue of statute of limitation on whether the suit was filed within time.
The jurisdiction of the court to hear the suit was also challenged by the respondents.
Mr David Amon, and Mr Polycarp Hamman were counsel to NIS and Head of Service respectively.
The aggrieved officer had alleged that the respondents “unjustly” denied him promotion over the years by keeping him in “limbo’’.
The claimant also prays the court to direct the respondents to issue him a letter of special promotion and decorate him with the new rank.
