Lagos, April 26, 2017 (NAN) A 35-year-old businessman, Hammed Isiaka, who allegedly obtained 61 bags of golden penny flour valued at N345,000 on false pretences,  on Wednesday appeared before an Ikeja Magistrates’ Court.

Isiaka, whose address was not provided, pleaded not guilty to the charges of obtaining money under false pretences, breach of peace and stealing slammed on him.

But the prosecutor, Sgt. Babaji Ishaku, told the court that the accused committed the offences sometime in February 2015 at Jibowu Street, Orile Agege, a Lagos suburb.

Ishaku said the complainant, Mr Olalekan Odunigba, gave the 61 bags of golden penny flour to the accused, who promised to pay back after selling them.

“The accused failed to pay back the money as promised which forced the complainant to report the case to the police.”

The offences contravened Sections 166, 285 and 312 of the Criminal Law of Lagos State, 2015 (Revised).

The News Agency of Nigeria (NAN) reports that Section 285 provides a three-year jail term for stealing, while Section 312 stipulates 15 years for obtaining by false pretences.

Ruling on the bail application of the accused, Magistrate J.A. Adegun granted him bail in the sum of N100,000 with two sureties in like sum.

The magistrate said the sureties must be gainfully employed and should also show evidence of tax payment to the Lagos State Government.

The court adjourned the case until May 3 for mention. (NAN)
