Applicant bags 1 year jail term for dealing in restricted narcotics

Lagos, Feb. 16, 2018 (NAN) A Federal High Court, Lagos, on Friday sentenced  29-year-old Tunde Folawewo, to one year jail term for drug trafficking.

The convict, an unemployed, was charged by the National Drug Law Enforcement Agency (NDLEA), on a count charge of trafficking in cannabis sativa (a.ka. Indian hemp).

The convict pleaded guilty to the charge.

After his plea, the prosecutor, Mr Jeremiah Aernan, reviewed the facts of the case and led one prosecution witness in evidence.

He tendered a written statement of the convict, a request for scientific aid form, and a bulk of the exhibit.

Aernan, thereafter, closed the case for the prosecution, and urged the court to sentence the convict in accordance with Section 356 (2) of the Administration of Criminal Justice Act, 2015, and based on evidences adduced.

In her judgment, Justice Hadiza Rabiu-Shagari found the convict guilty as charged and accordingly convicted him.

“The convict is hereby sentenced to a term of one year imprisonment, to be calculated from the date of his arrest.

“The drug exhibits are to be returned to the NDLEA for destruction,” she said.

In the charge, the prosecution said that the convict was arrested on Aug. 17, 2017, at the Ejigbo area of Lagos State, with 200g of the narcotics.

He said the offence contravened the provisions of Section 11 (c) of the NDLEA Act, Cap N30, Laws of the Federation, 2004.

Shortly, before his sentence, the convict who was not represented by a lawyer begged the court to show mercy on him and give him a second chance to make amends.

He promised never to make same mistake in the future. (NAN)
