Woman prays court to grant her custody of 3-year-old child after divorce

Kaduna, April 10, 2018(NAN) A young house wife, Husna Adam, on Tuesday, prayed a Sharia court ll at Magajin Gari, Kaduna, to allow her take care of her three-year-old daughter for a year after divorce.

Adam had filed a case against her husband, Hassan Sani, seeking divorce through “Khul’i” (redemption).

Her lawyer, Kabir Alhassan, told the court that: “My client wants to divorce her husband through Khul’i, as we all know in Islam; a woman has the right to seek for Khul’i when she fears she can no longer be obedient to her husband.”

The News Agency of Nigeria (NAN) reports that Khul’i is a form of divorce in Islam where a woman initiates the process and returns the dowry she received from her husband.

The complainant confirmed that she received N40,000 as dowry and would want to exchange the amount with one year care and custody of her child.

She also urged the court to compel Sani to take full responsibility of the child and pay the sum of N10,000 as monthly feeding allowance after one year.

The defendant’s counsel, Shaibu Lawal, who agreed that the complainant had the right for Khul’i, however, argued that issue of custody and care of the child shouldn’t be raised.

“Indeed the complainant has the right to demand khul’i, but the issue of child custody and care can’t be raised until the marriage has been dissolved.

“We want the court to take one step at a time, let’s finish with the divorce before talking about custody, for now the two parties are still couples,” he said.

Lawal begged the court to give him more time to provide evidences that would back his claim.

The judge, Malam Musa Sa’ad, adjourned the case to April 17 for further hearing. (NAN)
