Absence

Abuja, Oct. 27, 2017 (NAN) Hearing of a case of alleged cheating and forgery was stalled in a Wuse Zone 2 Senior Magistrates’ Court, Abuja due to the absence of the prosecutor, Mr Fidelis Ogbobe.
The Police had on Aug. 25, preferred a charge of alleged offence of cheating and forgery against Uchenna Nwadi.
Ogbobe told the court that on Jan. 17, Mrs. Felicia Iheanacho of Kubwa, Abuja reported the matter to the Command Metro Abuja.
He said that the defendant, an engineer, 45, who resides at Wuse 2, Abuja made the complainaint to pay certain amount of money for a transaction.
The defendant is also the director of NCR Associates, Wuse.
The prosecutor told the court that the complainant paid the sum of N2.5 million into the defendant’s company’s account to help her secure an approval for a building plan from the Development Control Department of the Federal Capital Development Authority (FCDA).
The prosecutor told the court that the defendant later brought an approval letter for building plan from FCDA which was later discovered to be fake.
He said that the defendant later pleaded with the complainant and issued her a Zenith bank cheque of the sum of N500, 000 which was rejected by the bank.
The prosecutor said the offence contravened Sections 364 and 322 of the Penal Code.
The defendant, however, pleaded not guilty to the alleged offence, his counsel Mr. Nicholas Elechi subsequently applied for his bail.
The Magistrate, Mrs. Elizabeth Woni admitted him to bail in the sum of N500, 000 and two sureties.
Woni then adjourned the matter until Oct. 27, for hearing.
At the resumed hearing on Friday, the prosecutor was absent in court when the matter was called and he did not notify the court about his absence. (NAN)
