Judgment debt suit against Police: Parties opt for amicable settlement

Abuja,Sept.7,2017 (NAN) The National Industrial Court, Abuja, on Thursday adopted parties terms of settlement as judgment, in a suit instituted by one Feyita Friday, and 26 others, against the Police Service Commission.
The claimants are seeking payment of judgment debt salary arrears.
The other claimants are: Victor Nnamdi, Anthony Itodo, Efe Agbabune, Gideon Okechukwu, Charles Obekpa, Patrick Wilson, Ehigathor Oduagbon, Rakiya Umar, among others.
Justice Waziri Abali, adopted the terms of settlement as the judgment of the court after counsel to parties endorsed the terms.
Earlier, claimants’ counsel, Mr Simon Ugbe, informed the court that parties had filed the terms of settlement as ordered by the court on Aug.31.
Ugbe urged the court to adopt the terms of settlement as judgment of the court in the suit.
He equally urged the court to discharge the judgment debtors as well as the garnishee respondent in the suit.
“My Lord, we have filed terms of settlement as directed by the court on Aug.31, the terms of settlement are before you.
“We hereby, humbly adopt these terms of settlement as judgment of the court in this garnisheeing proceedings.
“We also humbly urge the court to discharge the first and second judgment debtors, and the CBN garnishee respondent,” Ugbe said.
Mr B. Dada, first and second respondents counsel also confirmed Ugbe’s statement that they had amicably settled the matter.
“My Lord, that is the correct position, all we want is for the court to adopt the terms of settlement and discharge the garnishee proceedings,” he said.
The claimants were disengaged workers of the Police Service Commission who alleged that their salary was “unjustly” stopped by the commission four years ago.
They dragged the commission to court and judgment was delivered on Oct. 7, 2016 in favour of the claimants against the commission at the National Industrial Court, Abuja.
The claimants filed garnishee proceedings, asking the court to prevail on the respondents to pay them the judgment debt.
The claimants, who are the judgment creditors, joined the Chairman, Police Service Commission as judgment debtor.
The claimants also listed the Central Bank of Nigeria (CBN) as the garnishee respondent in the suit.
