Husband seeks dissolution of 6-year-old marriage for alleged adultery

Ado-Ekiti, Feb. ‎22, 2017 (NAN) A 35-year-old husband, Badmus Fatai, on Wednesday begged an Ado-Ekiti Customary Court to dissolve his six-year marriage to his wife, Sade, for alleged adultery, lack of care for the children and lack of respect for in-laws.

Fatai told the court that the respondent was fond of coming home late at night from her place of work.

The petitioner, an artisan, said the respondent would leave the house in the morning without preparing food for the children and himself.

The father of two children, told the ‎court that he caught the respondent dating an Ebira man who was a motorcyclist.

Fatai explained that when he caught them, he did not confront her but showed his displeasure through his attitude to her in the house.

The petitioner said that the respondent never acknowledged him as her husband and she was fond of receiving men’s phone calls while sleeping on the same bed with him.

Fatai alleged that for many months the respondent did not allow him to have sexual intercourse with her and she would travel for days without his permission.

“Whenever my wife travels without my permission, ‎I am always responsible for the feeding and welfare of the children.

“On Valentine’s day, my wife left the house at exactly 8.00 a.m without my consent and came back around 11.00 p.m wearing provocative clothes.

“I can no longer tolerate such habit from her in my house,” he said.

‎The petitioner appealed to the court to dissolve his marriage with the respondent to enable him live a peaceful life.

Witness of the petitioner, his father, Alhaji Rahmon Badmus, told ‎the court that the respondent was responsible for the problem in his son’s life.

Badmus said whenever there was a misunderstanding between his son and his ‎wife, he send for both of them to come but the respondent did not honour his calls.

He told the court that the respondent was fond of coming home at midnight, and he appealed to her to desist from such wayward lifestyle but ‎she refused to change.

Badmus agreed with his son’s decision that the court should dissolve the marriage for peace to reign in his son’s life.

The second witness of the petitioner, his mother, Mariam, told the court that the attitude of the res‎pondent was not good and contradicted the Islamic doctrine.

Mariam said the respondent was fond of wearing indecent clothes that would reveal the sensitive parts of her body and she had preached to her on several occasions but she refused to change.

The mother of the petitioner also appealed to the court to dissolve the marriage.

The President of the court, Mrs Olayinka Akomolede, ‎after hearing from the petitioner and his witnesses, adjourned the case till March 22 for further hearing.

Akomolede ruled that the respondent should come to the court with her witness on the adjourned date.

She urged both parties ‎to maintain peace until the court’s  would final verdict. (NAN)
