32-yr-old man arraigned for allegedly raping 6-yr-old girl

Ibadan, April 5, 2017 (NAN) A 32-year-old man, Chinaza Azubike, was on Wednesday arraigned in  an Oyo State High Court in Ibadan for allegedly raping a six-year-old girl.

The accused is facing one count of rape.

The Prosecutor, Mr Abdulrasak Alimi,  told the court that the accused unlawfully had canal knowledge of the minor without her consent.

He said that the incident happened on April 4, 2015,  at Oke Adu area of Ibadan.

The offence, he said,  contravened Section 357 of the Criminal Code Cape 38 Vol.11,  Laws of Oyo State of  Nigeria,  2000.

The accused, however, pleaded not guilty to the charge.

Testifying before the court, the prosecution  witness, Sgt. Eghune Emmanuel, said  the victim’s mother,  Mrs Victoria Augustine,  reported the case at Mapo Police Station.

He said a medical form was given to Augustine to take to Adeoyo Hospital for medical examination of her daughter.

“When the victim’s mother returned with the medical report from Adeoyo Hospital, it was confirmed that there was penetration into  the private part of the victim,’’ he said.

The prosecutor , however, sought for an adjournment to enable him produce the original document in  court.

“My Lord,  I will not be able to proceed with the testimony of the witness  because he was unable to bring the original document to the court,’’ he said.

Alimi said that documents he wanted to tender were in the original case file.

The counsel to the accused, Mr Kelvin Akinloye, did not oppose the plea for  adjournment.

Justice G.A. Sunmonu adjourned the case till May 11 for continuation of hearing and ordered the remand of the accused in prison.  (NAN)
