Assault

Ikeja, Aug. 17, 2018(NAN) Two men -Bidemi Johnson and Sunday Afolabi – on Friday appeared before an Ikeja Magistrates’ Court for allegedly beating-up a waiter.
Eighteen-year-old Johnson, a fashion designer, and 27-year-old Afolabi, a businessman, are facing a two-count charge of conspiracy and assault.
According to the prosecutor, ASP Ezekiel Ayorinde, the accused, both of whom reside at Alagbado, Lagos, committed the offences on Aug. 6 at Alakuko, Lagos.
Ayorinde said that the accused assaulted Mr Paul Obajimi by punching him and hitting him with beer bottles.
“They punched the complainant all over his body and also hit him several times with the bottles,” he said.
Ayorinde said that the accused beat up Obajimi for trying to maintain peace.
“The complainant, who served the accused drinks, saw that they were fighting; so, he tried to make peace, but the accused transferred their aggression to him,’’ he said.
The News Agency of Nigeria (NAN) reports that the offences contravene Sections 173 and 411 of the Criminal Law of Lagos State, 2015.
Section 173 prescribes a three-year jail term for assault, while conspiracy attracts two years’ imprisonment, according to Section 411.
The accused, however, plead not guilty to the charge.
The Magistrate, Mrs B.O OsunsanmI, granted the accused bail in the sum of N50, 000 each with one surety each in like sum.
Osunsanmi ordered that the sureties should be gainfully employed and show evidence of two years’ tax payment to the Lagos State Government.
The case was adjourned until Sept. 24. (NAN)
